This Privacy Policy (“Privacy Policy”) describes how Stratford Ltd. (“Company” “we” “us” or “our”) collect, use, and share your Personal Data, as well as an explanation of the data rights you may have. This Privacy Policy applies to our visitors and users as follows: (ii) any visitor of our Website available at: https://shelfy.io/ (“Visitor”) ; (ii) our customers the merchants using our Services (“Merchants”); and (iii) the end users, consumers, purchasing the goods and services from the Merchant through the App created by the Shelfy Platform (“End User”).

Visitors, Merchants and End Users shall be collectively referred to herein as “you” or “your“.

This Privacy Policy is an integral part of our Terms of Service and Merchant SaaS Agreement (“Terms“) which includes additional information and conditions regarding our Service. Any capitalized terms used herein but not defined herein shall have the meaning ascribed to them in the Terms.

1. INFORMATION COLLECTED AND PROCESSED BY THE COMPANY

We may collect two types of data and information from you, depending on your interaction with us. The first type of information is non-identifiable and anonymous information (“Non-Personal Data”). We are not aware of the identity of the individual from who we have collected the Non-Personal Data. Non-Personal Data which is being gathered consists of technical information, and may contain, among other things, the type of operating system and type of browser, type of device, your action in the Website or Services (such as session duration and page impressions), or approximate geo-location.

The second type of information is individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual (“Personal Data”).

In order to use our Services, you will be required to register and open an account. During the registration process we will collect certain information such as your full name, physical address, email address, payment information, etc.
To provide the Services to the Merchant.
Performance of a contract with you or in order to take steps at your request prior to entering into a contract.
Direct Marketing
As our customer we will send you invoices, reports and marketing materials regarding the Services you are currently using or any services we may offer in the future (“Direct Marketing”).
You are able to unsubscribe from receiving such correspondence from us by clicking on the designated link in the applicable message that we will send you or by contacting us at: info@shelfy.io. Please note that if you choose to unsubscribe from our Direct Marketing, we may still retain your contact details and send you relevant service-related information.

Payment Details
In the event the payments of the Service Fees are paid directly by Merchant to Company, we will collect certain payment information.
We use third party payment processors to process this information. Consequently, any transactions that are processed by these third-party payment processors will be governed by their privacy policies and terms which we recommend that you review.

Log in and contact information
When the End User logs in either through a third party or through your Facebook, Google+ or Apple account, we will process certain information such as your ID, name and may process information you made public through such platform.
We will use this data for the purpose of providing our Services and designate your account. Your contact details will be used in order to send you needed information related to our Services. In addition, it will be used for additional occasional communications and updates related to the Services, as well as promotional and marketing emails. We act as the processor when we collect and process this type of data, which is processed on behalf of our customer.
Performing our contract with you.
Shopping History
When you access or use the App, we will collect and process your App and Web Shop’s shopping related data (such as purchased products, date of purchase, quantities, prices, etc.) (“Shopping History”).
We will use this data for the purpose of performing research, and conducting analytical operations. In addition, we will use this data as part of providing the services to the Merchant including providing promotional and marketing activates on its behalf, such as providing End User with relevant offers. We act as the processor when we collect and process this type of data, which is processed on behalf of our customer (the Merchant).
We process this on behalf of our customers (the Merchants) as a processor/service provider, therefore, we rely on the lawful basis established by our customers.

2. HOW WE COLLECT INFORMATION

Depending on the nature of your interaction with us, we may collect information from you in one or both of the following ways:

  • Automatically– we may use cookies (as further elaborated below) or other similar tracking technologies to gather some information automatically when you interact with our Website and Service.
  • Provided by you voluntarily– we will collect information if and when you choose to provide us with the information, such as through the Service, when you contact us or sign up for our newsletter.

3. SHARING DATA WITH THIRD PARTIES

We will not share your Personal Data with third parties, other than as specifically mentioned herein:

  • Compelled Disclosures – To satisfy any applicable law, regulation, legal process, subpoena or governmental request;

If you object to the aforesaid collection, use and sharing of data, please immediately cease using the Services and/or Platform.

Where provided under applicable law (such as, within the European Union), you may have the right to ask us to delete Personal Information, subject to applicable exceptions, such as in order to preserve that information for anticipated litigation or demands from a regulator, or some or all of the following rights: the right to obtain information on our use of your Personal Data, the right to obtain a copy thereof, the right of data rectification, the right to data portability, the right to object to processing based on our legitimate interests, the right to restriction of the processing, and the right to withdraw your consent.

Note that we may request proof of identity, and we reserve the right to charge a fee was allowed by law, such as in circumstances where your request is excessive. In addition, you may have the right to lodge a complaint with a supervisory authority, subject to applicable law (as is the case in the European Union).

6. DATA RETENTION

We retain Personal Data for as long as it remains necessary for the purposes set forth above, all in accordance with applicable laws or until an individual requests to opt-out of such collection, subject to applicable laws. We may at our sole discretion, delete or amend information from our systems, without providing any notice to you, once we deem it is no longer necessary for our purposes.

Please note that except as required by applicable law, we will not be obligated to retain your data for any particular period, and we may delete it for any reason and at any time, without providing you with prior notice of our intention to do so.

7. SECURITY

We take great care in implementing and maintaining the security of your Personal Data. We employ industry standard procedures and policies to ensure the safety of individuals’ information and prevent unauthorized use of any of such. We have implemented technical, physical and administrative security measures to protect your Personal Data. In the event of a security incident in which we discover that your Personal Data may be at risk, we will take reasonable efforts to notify you and the applicable authority (if we are required to do so, subject to applicable laws).

8. DATA TRANSFER

Our data servers in which we host and store the information are located in the US and EU. The Company’s HQ are based in Israel in which we may access the information stored on such servers or other systems such as the Company’s ERP, CRM, Salesforce and other systems. In the event that we need to transfer your Personal Data out of your jurisdiction, we will take appropriate measures to ensure that your Personal Data receives an adequate level of protection as required under applicable law. Furthermore, when Personal Data that is collected within the European Economic Area (“EEA“) is transferred outside of the EEA to a country that has not received an adequacy decision from the European Commission, we will take necessary steps in order to ensure that sufficient safeguards are provided during the transferring of such Personal Data, in accordance with the provision of the standard contractual clauses approved by the European Union.

9. CHILDREN

The Website and our Service are not intended for use by children (the phrase “child” shall mean an individual that is under the age defined by applicable law which with respect to the European Economic Area (“EEA“) is under the age of 16 and with respect to the U.S.A, under the age of 13) and we do not knowingly process  children’s information. We will discard any information that we receive from a user that is considered a “child” immediately upon our discovery that such a user shared information with us. 10. DO NOT TRACK DISCLOSURE

We do not support Do Not Track (“DNT“). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.
